Overview of Agency
From 1 July 2016, the Courts Administration Legislation Amendment Act 2016 merged the corporate services of the Family Court of Australia and the Federal Circuit Court of Australia with the Federal Court of Australia into a single administrative entity – the Federal Court of Australia. The entity also includes the National Native Title Tribunal.

The Act makes provision for the courts to share corporate services including Human Resources, Information Technology, Finance as well as other functions.

Under the arrangement, each court remains independent to fulfil its statutory obligations. Heads of Jurisdiction continue to be responsible for managing the administrative affairs of their respective courts (excluding corporate services), with assistance from a Chief Executive Officer and Principal Registrar.

All staff of the courts are employed by the Federal Court of Australia under the Public Service Act 1999 regardless of which court or tribunal they work for or provide services to.

Overview of the new Corporate Services function
The amalgamation of the Corporate Services functions previously performed separately within the Federal Court of Australia and the Family Court and Federal Circuit Court is now provided through a single, amalgamated function which commenced on 1 July 2016.

It is essential to the ongoing success of the amalgamation process and the continuing operations of the Federal Court, the Family Court and the Federal Circuit Court that the merger is a success and that key stakeholders are appropriately supported as the organisational changes occur.

The role of Director Property & Procurement is critical to this process.

Position Overview
The role of the Director Property & Procurement (DPP) has oversight of the property and facilities management portfolio, together with the procurement & contract oversight. The DPP plays a key role in supporting the Courts’/Tribunal’s strategic objective to be a cost efficient and effective organisation.

The Director will focus on the development and delivery of the Courts’/Tribunal’s national property and accommodation strategy, works program and initiatives, including the project management of fit-out alteration and additions and the management of the Courts’/Tribunal’s outsourced property services contracts.

The role requires in-depth knowledge and application of property and facility management planning, standards and practices, as well as the legislative and statutory requirements that apply to the management of the Court’s property arrangements including the overarching Australian Public Service (APS) property management guidelines.

The DPP also oversees all procurement-related functions for the Courts/Tribunal. The position’s major focus is to develop procurement and contracting strategies to ensure contracts and service level agreements deliver financially-sustainable outcomes for the Court. Other objectives include the development and application of practices and procedures for the effective management of both current and future strategic and operational procurement processes.

The role requires a sound understanding of procurement planning, standards and practices as well as the legislative and statutory requirements that apply to the management of the Court’s procurement arrangements including the Public Governance, Performance and Accountability Act 2013 and the Commonwealth procurement Rules.

The DPP must be solutions-focused and demonstrate the ability to plan strategically, and initiate, implement, manage and evaluate complex programs, projects and initiatives.

The DPP will be proficient in all aspects of written and oral communication, making appropriate recommendations for approvals to the Executive Director and/or the Courts’/Tribunal’s Executive.

The DPP must provide timely, expert advice on sensitive property and procurement management issues, policy, legislation, systems and processes while maintaining and developing key strategic relationships with all stakeholders. The DPP effectively manages change and addresses workplace performance issues where these might arise within the Property & Procurement function. The DPP contributes to the wider Courts’/Tribunal’s planning and participates in implementing Australian Public Service objectives with a specific focus on expert advice on property and procurement policy and management.

The occupant of this position is required to work cooperatively with key Court and external stakeholders to ensure that the property, facilities management, procurement and contract planning, policies, procedures and advice meets relevant requirements and performance expectations.

Additionally, the DPP will need to establish and maintain robust working relationships with relevant industry contacts to ensure that property, facilities management and procurement activities align with best practice.

Finally, the DPP evaluates team and individual performance, develops staff, promotes a healthy and safe workplace environment, and models ethical behaviour in accordance with the APS Code of Conduct and its Values.

Major Activities

  1. Establish and maintain key strategic internal and external stakeholder relationships as the Property & Procurement function evolves following the implementation and ongoing operations of the amalgamated Corporate Services function.
  2. Undertake strategic and operational business planning activities to provide clear guidance and direction to the Property and Procurement teams in relation to the implementation of the amalgamated function and service delivery to key clients.
  3. Provide strategic and operational technical advice and support to the Court’s/Tribunal’s staff and senior management on Property and Procurement policy, processes, systems and issues.
  4. Drive a commercial and a consistent approach to the efficient and effective planning and implementation of contracts and agreements for the procurement of goods and services.
  5. Ensure contracts and agreements provide value for money for the Court through competitive market testing and rationalisation of service provision.
  6. Provide, in conjunction and consultation with relevant sponsors, contract management services to the Court, including the preparation of requests for tender, contract risk analysis, development and negotiation of contract terms and conditions, and the management of contract performance.
  7. Provide high-level contract management advice in support of the Court’s Business and Strategic Plans.
  8. Strategically plan, implement, manage, review and evaluate a range of transitional projects and initiatives with a focus on confirming the operating environment for the Property & Procurement function and ensuring that it meets organisational needs and statutory obligations into the future.
  9. Take overall responsibility for the Courts’/Tribunal’s Property and Facilities & Procurement functions ensuring their compliance with relevant legislation, regulations, statutory obligations and accounting standards.
  10. Lead and guide the development of budgets and management of projects, finances, contracts, procurement and expenditure within the section.
  11. Develop, coach and mentor staff to build a high-performance team with a commitment to shared goals.
  12. Lead and exemplify a healthy and safe working environment, modelling and promoting ethical behaviour and practices that are consistent with the APS Code of Conduct and APS Values.

Competencies & Attributes
Demonstrated proficiency in the following:

  • Successfully leading a team through significant change and performance improvement programs;
  • A ‘customer-centric’ approach to working and dealing with external and internal stakeholders and building users;
  • Project and financial management skills and experience – delivering client centred property and facilities management outcomes within agreed timeframes and budgets;
  • Strategic property and facilities management planning and management – developing, implementing and reviewing organisational property portfolios, strategies and plans;
  • Property and facilities policy development, implementation and review; and
  • Procurement and contract planning, policies, procedures and advice

Formal Qualifications
Degree or extensive senior level experience in a relevant field e.g. Property/procurement/contracts management.

Special Requirements
Flexibility to regularly travel interstate.

Eligibility
Employment with the Court is subject to the conditions prescribed in the Public Service Act 1999, and the following:

  1. Australian citizenship – the successful applicant must hold Australian citizenship;
  2. Security and character clearance – the successful applicant must satisfy a Police Records Check, and may also be required to complete security clearances during the course of their employment;
  3. Health clearance – the successful applicant may be required to complete a health declaration or attend a medical assessment to confirm their fitness for duty.
